Nigerian Entertainment News: Mohbad’s Father Appeals Court Decision Clearing Naira Marley and Sam Larry
In a fresh twist to the ongoing controversy surrounding the death of rising music star Mohbad, his father, Joseph Aloba, has approached the Court of Appeal in Lagos to contest a recent High Court ruling that upheld the legal advice clearing singer Naira Marley and music promoter Sam Larry of any wrongdoing
The appeal, filed before the Lagos Division of the Court of Appeal, challenges the judgment delivered by Justice D.T. Olatokun on July 2, 2025.
Represented by his legal counsel, Wahab Shittu (SAN) and Don Akaegbu, Aloba is questioning the legitimacy of the legal recommendation issued by the Director of Public Prosecutions (DPP), which served as the foundation for absolving the duo in the controversial case.
As reported by PUNCH Metro, legal documents reveal that Aloba criticized the trial court’s stance that the Attorney-General’s constitutional powers under Section 211(1) of the 1999 Constitution were unrestricted and not subject to judicial examination.
He argued that the use of prosecutorial discretion must be consistent with principles of equity, accountability, and societal interest, and should never serve as a means to protect individuals from due legal process.
Citing the legal precedent set in Elias v. Arkas (2018) 10 NWLR (Pt 1626) Pg 37, Aloba emphasized that the Attorney-General’s powers must remain under the scrutiny of the courts, especially in situations where such powers may have been applied unfairly or without transparency.
